CSC RULED that MMA 279 can not be applied to Teachers

Muslim Mindanao Act (MMA) 279 passed by the ARMM Regional Legislative Assembly (RLA) grants eligibility or permanent status to employees in ARMM after five (5) years of continued service. 

In a resolution promulgated by the Civil Service Commission (CSC) last June 5, 2012, held that MMA 279, can not be applied because in the absence of ARMM Civil Service Law, the Civil Service Law under the national government prevails.

CSC Resolution No. 1200858 states:
"Clearly, permanent appointments shall only be issued to persons who meet all the minimum requirements for the position to which he/she is appointed, including the appropriate eligibility prescribed. In the instant case, teachers who were appointed under a provisional status for lack of eligibility may not be given permanent appointment specifically because they lack the required eligibility as provided by law."
